Arizona Divorce Law
Arizona Divorce attorney, Scott David Stewart, leads a small boutique law firm which practices exclusively in divorce and family law. The firm's lawyers consider themselves client advocates and make it their sole focus to see positive outcome for clients- be it a child custody, child support or typical Arizona divorce matter.
The Law Offices of Scott David Stewart limits the number of cases taken, so that only the highest level of client service is attained.Child Custody
Are you worried about an Arizona custody dispute? Do you wonder which parent will get the children? Custody decisions in Arizona are based on what is in the best interests of the child, and such decisions frequently involve the professional advice of a child custody evaluator.
Determining what is in the best interests of the children is always our law firm’s primary concern, just as it is for our clients.
When you need information to develop a written parenting plan for joint custody; when you want access to your child with reasonable parenting time; when a frequent visitation schedule is essential to keep a distant parent in touch with their children, our Attorneys will guide you through the child custody procedures that are essential to the successful outcome in your case.
Child Support

Need help calculating child support? Our child support lawyers determine each parent’s support obligation under the Arizona Child Support Guidelines.
Whenever there are children involved in a divorce, paternity establishment action, legal separation, or annulment, mandatory child support obligations will be designated and ordered. If you seek primary physical custody of your children, then you will need to know that the other parent will provide for their support. If the other parent will have custody, then you are probably concerned about managing your monthly child support obligation. Calculating aggregate income under the Arizona Child Support Guidelines is required to establish each parent’s child support obligation.
Once our attorneys have calculated each parent’s support obligation, they then identify any special circumstances that justify advocating a departure from the guidelines. Because such a departure is at the Court’s discretion, persuasive legal advocacy from our experienced child support lawyers is essential for optimal results in the family law case.
Alimony

Unlike child support, there are no mandatory Arizona guidelines to follow in determining an award of alimony, or spousal maintenance.
Instead, our spousal maintenance attorneys advocate the client’s position on each factor to be considered by the court.
A few of those factors include: the duration of the marriage, the standard of living the couple enjoyed, and the education, financial resources, and employability of the party seeking spousal maintenance. We often utilize the expert services of a vocational evaluator to analyze the employment potential and earning capacity of the recipient spouse.
When alimony is awarded, payments may be spread out over a period of time or made in lump sum. Alimony may be taken in the form of a transfer of personal property or, perhaps, in the form of possession of real property for a set period.
Division of Property
The division of marital assets and debts in a divorce is a great source of apprehension for those seeking our help. How are marriage assets split? Who decides who gets what? Who gets the house? Who pays which bills?
Dividing up your marital assets and debts involves strategic negotiation and, when necessary, aggressive litigation. Our licensed Arizona attorneys are very knowledgeable and experienced in all matters of property and debt settlement.
For example: identifying each item of property as the separate asset or debt of one spouse, or the community property of both spouses; determining whether there has been marital waste of a community asset, such as the diminishment of a bank account to maintain an extra-marital relationship; tracing the transmutation of property by gift to the marriage; and locating hidden or concealed assets by investigating clues in documents, behaviors, and tax returns are all things that we do every day.
